Luyanda Maema

Luyanda is a Legal Intern at PPM Attorneys. She holds a Bachelor of Science and a Bachelor of laws obtained from the University of the Witwatersrand. She brings strong research, writing and organisational skills, approaching every task with precision and initiative.

Luyanda is interested in Cyberlaw; Privacy Law and POPIA; Information Security; Media Law; Technology and Telecommunications.

Outside of the legal space, Luyanda enjoys solving puzzles and strategy games. She has a creative side too, with a strong appreciation for visual art and design. When she’s not indoors, she enjoys hiking and camping.

Experience

• Assisted in reviewing various commercial contracts, non-disclosure agreements, and privacy agreements for clients.
• Assisted with drafting of legal memorandums and opinions for clients.
• Assisted on due diligence projects for commercial, and licensing and regulation.
• Assisted with copyright licensing in the form of transactional licenses, blanket licenses and general licenses.
• Conducted in-depth research into South Africa’s copyright regime, critically analysing the balance between protection of rightsholders and the public;
• Investigated the misalignment between the Copyright Bill and ECTA, contributing to the power imbalances for rightsholders;
• Explored the ‘value gap’ concept in online copyright infringements and its impact on policy reform.
• Assisted in drafting advisory opinions for clients;
• Drafted and reviewed privacy and IT related policies;
• Attended to research for ICASA related compliance matters and drafting compliance related advice;
• Assisted in reporting security data breaches to the Information Regulator;
• Conducted research into the issue of Business Email Compromise and Cybercrimes in South Africa analysing the gaps in cybercrime regulation particularly as it relates to imputing liability.
• Conducted research into ‘sharenting’ and image rights violations, analysing the expectations of parents in terms of the Children’s Act. The research considered children’s rights and capacity, as well as whether POPIA effectively protected children’s image rights.
• Assisted in reviewing privacy policies for data privacy and compliance programs involving the Protection of Personal Information Act;
• Attended to compliance-related matters for telecommunication companies;
• Assisted in reviewing privacy notices and data transfer agreements.
• Attending to Debt collection matters;
• Drafting High Court and Magistrate Court Pleadings from the inception to the completion of matters;
• Drafting summons and notices;
• Drafting letters of demand;
• Drafting discovery affidavits and close of pleading notices;
• Gathering information and records;
• Liaising with clients;
• Indexing and paginating;
